Der Gegenstandswert der Vollstreckbarerklärung wird auf 17.169,59 EUR festgesetzt.
G r ü n d e:
Im Verfahren über die Vollstreckbarerklärung ist der volle Wert des Schiedsspruchs oder des Schiedsvergleichs maßgeblich. Aus dem Schiedsspruch vom 14.01.2002 kann die Schiedsklägerin 23.000,-- DM (= 11.759,71 EUR), aus dem am 15.02.2002 abgefaßten ergänzenden Schiedsspruch kann sie weitere 5.409,88 EUR vollstrecken.

Declaration of enforceability of arbitral award/Order determining the value in dispute
R u l i n g:
The value in dispute of the declaration of enforceability is fixed at 17,169.59 EUR.
For the purpose of the declaration of enforceability, the value in dispute is determined on the basis of the overall value of the arbitral award or arbitral settlement.
On the basis of the arbitral award of 14.01.2002, the claimant (in the arbitral proceedings) can seek execution of the arbitral award to the amount of 23,000.00 DM (= 11,759.71 EUR), and 5,409.88 EUR on the basis of the additional award of 15.02.2002.
